Regulation No. 44/2020 on changes in the operation of the University in the state of epidemic caused by SARS-CoV-2 coronavirus

Regulation No. 44/2020 of the Rector of the University of Warmia and Mazury in Olsztynof 6 May 2020

on amending Regulation No. 37/2020 of the Rector of the University of Warmia and Mazury in Olsztyn of 26 March 2020 on changes in the operation of the University in the state of epidemic caused by SARS-CoV-2 coronavirus

 

Pursuant to Art. 76a of the Act of 20 July 2018 – Law on Higher Education and Science (consolidated text Dz. U. of 2020 item 85 as amended) and Art. 17.4 of the Statute of the University of Warmia and Mazury in Olsztyn, attached as Appendix to Resolution No. 494 of the Senate of the University of Warmia and Mazury in Olsztyn of 21 May 2019 on the Statute of the University of Warmia and Mazury in Olsztyn (as amended), it is hereby ordered as follows:

Art. 1

The following changes are introduced to Regulation No. 37/2020 of the Rector of the University of Warmia and Mazury in Olsztyn of 26 March 2020 on changes in the operation of the University in the state of epidemic caused by SARS-CoV-2 coronavirus:

1)  In Article 1, after Paragraph 8, the following Paragraphs 8a – 8b shall be added:

“8a.     The Dean, the Branch Director and the Director of the Public Health School, in agreement with the internship supervisor and the head of the doctoral programme, director of the doctoral school, head of the postgraduate studies, can decide to shorten the duration of the internship covered by the study curriculum, describing another, alternative method to acquire the assumed learning objectives or to recognize the internship completed so far and to define the method to supplement missing learning outcomes resulting from the internship. This provision applies to internships already started by the students and to internships that have not yet been started.

8b.       In the academic year 2019/2020, courses or groups of courses carried out in the form of internships in the programmes preparing to the profession of a teacher and in postgraduate studies preparing to the profession of a teacher started before 1 October 2019 and ending in the academic year 2019/2020, can be conducted with the use of online teaching methods and technologies.”

2)  In Article 1, after Paragraph 10, the following Paragraphs 10a - 10m shall be added:

“10a.   The process of verifying learning outcomes must enable the assessment of the achieved learning outcomes related to a given course/group of courses.

10b.     The verification of learning outcomes is carried out with the use of IT tools, excluding the need to generate costs on the part of the student, doctoral student, or postgraduate student for the use of a given IT tool.

10c.     The verification referred to in Paragraph 10b, is carried out by the teacher responsible for verifying the achievement of learning outcomes.

10d.     A student, a doctoral student or a postgraduate student may be subject to the verification referred to in Paragraph 10b provided that a connection is established with the examiner or the teacher using the IT tools referred to in Paragraph 10b on a date established by the examiner or the teacher, agreed upon with students at least three days before the date of the examination or the course completion assessment.

10e.     Before undertaking the verification referred to in Paragraph 10b, the examiner or the teacher shall verify the identity of the student, doctoral student or postgraduate student by visual inspection of the student’s identity card or other identity document using a video connection.

10f.     The verification of learning outcomes is recorded by the examiner or the teacher in the form of an examination or course completion assessment report, subject to the provisions of Paragraphs 10g and 10l.

10g.     The report referred to in Paragraph 10f should contain the following data: given name (names) and surname of the examiner or the teacher assigning the completion of the course, the date of the exam or the course completion assessment, the name of the course, the list of students taking the examination or the course completion assessment and any comments concerning the course of the examination or the test.

10h.     The examiner or the teacher shall organize the examination or the course completion assessment in such a way as to ensure that the student, doctoral student or postgraduate student work on their own and the course of the examination or the course completion assessment is supervised.

10i.      In the case of justified doubts of the examiner or the teacher concerning the unaided and subjective course of the examination or the course completion assessment, the examiner or the teacher may interrupt the examination or the course completion assessment.

10j.      In circumstances referred to in Paragraph 10i, the examiner or the teacher shall establish an additional date. The provisions of Regulation No. 5/2014 of the Rector of the University of Warmia and Mazury in Olsztyn of 24 January 2014 on defining prohibited forms of behaviour of students, doctoral students and post-graduate students and course participants during examinations or course completion assessments shall apply to a student, a doctoral student, a postgraduate student or a course participant who has violated the internal regulations applicable at the University of Warmia and Mazury in Olsztyn concerning unaided work.

10k      If the connection during which the examination or the course completion assessment is conducted is interrupted due to technical problems, the examiner or the teacher shall decide whether it is necessary to repeat the examination or the course completion assessment entirely or in part, or if the examiner or the teacher considers that until the interruption of the connection it was possible to verify the assumed learning outcomes, the examiner or the teacher issues a grade, taking into account the course of the examination or the course completion assessment.

10l.      The achieved learning outcomes are assessed and documented in a manner adopted at the University of Warmia and Mazury in Olsztyn, using the University Study Support System.

10ł.      At the request of the student, the doctoral student or the postgraduate student, the examiner or the teacher shall permit the presence of an assistant/sign language interpreter in the room, provided that this results from the conditions for conducting an examination or course completion assessment adapted to the needs of persons with disabilities agreed in advance with the Office for Persons with Disabilities, while maintaining safety conditions related to the state of epidemic threat or the state of epidemic.

10m.    In case of a course completion assessment or an examination conducted before an examination board, the provisions concerning the course of the diploma examination, specified in §1a shall apply accordingly.”

3)  In Article 1, Paragraph 12 shall be replaced by the following:

“12.     The use of the University Library collection in the library premises and in its all branches and reading rooms is suspended, subject to Paragraph 12a.”

4)  In Article 1 after Paragraph 12, the following Paragraph 12a shall be added:

“12a.   The Lending Desk in the University Library starts to operate. The rules of using the Lending Desk are described in the Appendix to the Regulation.”

5)  After Article 1. the following Article 1a and Article 1b shall be added:

 

 

“Art. 1a

1.  The rules for conducting a diploma examination with the use of information technologies at the University of Warmia and Mazury in Olsztyn are introduced.

2.  The diploma examination during the time when didactic activities are suspended in the University is carried out with the use of MS Teams.

3.  A person appointed by the dean, the director of a branch, and the director of the School of Public Health, who is not a member of the Diploma Examination Board (hereinafter referred to as the Board) and who provides technical support, may be admitted to be present during the diploma examination.

4.  Before taking the diploma examination, the Chairperson of the Board shall check the student’s identity by visual inspection of the student’s identity card or other ID document using a video connection.

5.  The diploma examination is recorded as an audio-video file.

6.  In order to take the diploma examination, the student is obliged to:

1) ensure, for their own use, a device supporting MS Teams, equipped with a camera and a microphone, and access to the Internet, guaranteeing the audio and video transmission of appropriate quality, subject to the provisions of point 2,

2) submit an application to the dean/director to ensure conditions for conducting the examination in the premises of the University of Warmia and Mazury in Olsztyn; if the student is unable to ensure the conditions referred to in point 1, the dean/director shall provide conditions for conducting the examination in the premises of the University, while maintaining safety conditions related to the state of epidemic threat or the state of epidemic,

3)  prepare the room where the student will be staying during the diploma examination in such a way that no other person will be present, no other multimedia devices (in particular telephones, tablets, etc.) will be present except for the device through which the examination will be conducted. At the request of the student, the Chairperson of the Board shall allow other persons to be present in the room, provided that this results from the conditions for carrying out the diploma examination adapted to the needs of persons with disabilities, previously agreed with the Office of Persons with Disabilities, ensuring with safety conditions related to the state of epidemic threat or the state of epidemic,

4)  make audio and video available during the diploma examination (it is not allowed to switch off the camera or to switch off or mute the microphone) and to be continuously present in the camera view. At the request of the Board, the student is obliged to make their device screen available.

7.  If the Board finds that there has been a breach of the conditions of the diploma examination as a result of the student's fault, the examination shall be discontinued, subject to the provisions of Paragraph 8.

8.  If the circumstances referred to in Paragraph 7 arise, the Board shall set another date. The provisions of Regulation No. 5/2014 of the Rector of the University of Warmia and Mazury in Olsztyn of 24 January 2014 on defining prohibited forms of behaviour of students, doctoral students, post-graduate students and course participants during examinations or course completion assessments shall apply to the student who has violated the internal regulations in force at the University of Warmia and Mazury in Olsztyn concerning unaided work.

9.  In the event that the connection between the student and the Board is interrupted during the diploma examination, as a result of activities beyond the control of the student or the Board, an attempt must be made to resume the connection immediately. If it is not possible to resume the connection, the examination must be retaken on another date.

10. After the diploma examination has been completed and the grade has been immediately agreed upon by the Board, the student shall be informed of the result via the information technology used to conduct the examination.

11. The file containing the recording of the diploma examination shall be kept until the diploma examination report is approved by all members of the Board.

12. The diploma examination report is drawn up immediately after the end of the examination, allowing the use of the circulation procedure.

13. Any matters not covered by the regulations shall be decided by the dean or the director, respectively.

Art. 1b

1.   At the University of Warmia and Mazury in Olsztyn, the rules for conducting the examination for the completion of post-graduate studies (hereinafter, the examination) with the use of information technologies are introduced.

2.   The examination for the completion of post-graduate studies during the time when didactic activities are suspended in the University is carried out with the use of IT tools, excluding the need to generate costs on the part of the postgraduate student for the use of a given IT tool.

3.   A person appointed by the dean/director, who is not a member of the Board and who provides technical support, may be admitted to be present during the examination.

4.   Before taking the examination, the Board shall check the post-graduate student's identity by visual inspection of the student's identity document using a video connection.

5.   The examination is recorded as an audio-video file.

6.   In order to take the examination, the post-graduate student is obliged to:

1) ensure, for their own use, a device supporting the IT tool used, equipped with a camera and a microphone, and access to the Internet, guaranteeing the audio and video transmission of appropriate quality, subject to the provisions of point 2,

2) submit an application to the dean/director through the head of the post-graduate studies to ensure conditions for conducting the examination in the premises of the University of Warmia and Mazury in Olsztyn; if the post-graduate student is unable to ensure the conditions referred to in point 1, the dean/director shall provide conditions for conducting the examination in the premises of the University, while maintaining safety conditions related to the state of epidemic threat or the state of epidemic,

3)  prepare the room where the student will be staying during the diploma examination in such a way that no other person will be present, no other multimedia devices (in particular telephones, tablets, etc.) will be present except for the device through which the examination will be conducted. At the request of the post-graduate student, the Chairperson of the Board shall allow other persons to be present in the room, provided that this results from the conditions for carrying out the diploma examination adapted to the needs of persons with disabilities, previously agreed with the Office of Persons with Disabilities, ensuring with safety conditions related to the state of epidemic threat or the state of epidemic,

4)  make audio and video available during the diploma examination (it is not allowed to switch off the camera or to switch off or mute the microphone) and to be continuously present in the camera view. At the request of the Board, the post-graduate student is obliged to make their device screen available.

7.  If the Board finds that there has been a breach of the conditions of the examination as a result of the post-graduate student's fault, the examination shall be discontinued, subject to the provisions of paragraph 8.

8.  If the circumstances referred to in Paragraph 7 arise, the Board shall set another date. The provisions of Regulation No. 5/2014 of the Rector of the University of Warmia and Mazury in Olsztyn of 24 January 2014 on defining prohibited forms of behaviour of students, doctoral students, post-graduate students and course participants during examinations or course completion assessments shall apply to the postgraduate student who has violated the internal regulations in force at the University of Warmia and Mazury in Olsztyn concerning unaided work.

9.  In the event that the connection between the postgraduate student and the Board is interrupted during the examination, as a result of activities beyond the control of the postgraduate student or the Board, an attempt must be made to resume the connection immediately. If it is not possible to resume the connection, the examination must be retaken on another date.

10. After the examination has been completed and the grade has been immediately agreed upon by the Board, the postgraduate student shall be informed of the result via the information technology used to conduct the examination.

11. The file containing the recording of the examination shall be kept until the diploma examination report is approved by all members of the Board.

12. The examination report is drawn up immediately after the end of the examination, allowing the use of the circulation procedure.

13. Any matters not covered by the regulations shall be decided by the dean or the director, respectively, in agreement with the head of the postgraduate studies”.

6)   In Article 2, Paragraph 2 is replaced by the following:

“It is prohibited to conduct any activities of student agencies or clubs or catering units, except for providing take away catering services.”

7)   In Article 2, Paragraph 4 is replaced by the following:

“Sports facilities of the University of Warmia and Mazury in Olsztyn, including the Equestrian Centre, can be used, provided that the rules laid down in current generally applicable regulations are followed.”

§ 2

The Regulation becomes effective as of the day of signing.
